Maryland, DC attorneys general plan lawsuit against Trump

Critics, including Citizens for Responsibility and Ethics in Washington, which is acting as counsel to the attorneys general in Maryland and Washington DC, claim Trump's decision not to divest his ownership of his business empire has put him in violation of the Constitution from the start of his presidency.

However, the case from two Democratic attorneys general could stand a better chance in court as the first government action over allegations that Trump, a Republican, violated the constitution's so-called emoluments clause.

The Maryland General Assembly approved a resolution allowing frosh to sue the federal government without permission from Governor Hogan last March. Trump insisted in January that he was moving business assets into a trust to be managed by his sons and eliminate possible conflicts. The case would likely end up before the Supreme Court and the president's lawyers could explain why his returns should not be made public, Frosh and Racine told the Post. "We're bringing suit because the president has not taken adequate steps to separate himself from his business interests".

In January, Trump vowed to track and donate all profits made by Trump Organization from foreign governments to the U.S. Treasury.

It said the embassy of Kuwait had planned to hold an event at a Four Seasons hotel but eventually moved it to the Trump property, which is called the Trump International Hotel.

Norman Eisen, who served as White House ethics lawyer for President Barack Obama and is CREW's board chairman, said jurisdictions such as the District and Maryland are among the "most flawless plaintiffs" to sue over emoluments because they have a coequal say in making sure the Constitution is being enforced.

The suit will allege that Trump has taken favors from the US government. But after Trump proposed increasing GSA's budget, the agency issued a letter saying Trump was in full compliance with the lease. The justice department is seeking to have the suit dismissed.
