Software update can fix Fiat Chrysler's US diesel issue -lawyer

The U.S. government filed a civil lawsuit on Tuesday accusing FCA of illegally using software to bypass emission controls in 104,000 vehicles sold since 2014, which it said led to higher than allowable levels of nitrogen oxide (NOx) that are blamed for respiratory illnesses.

In January, the EPA and California accused Fiat Chrysler of unlawfully using undisclosed software to permit excess diesel emissions in 104,000 USA 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks in a notice of offense.

The control devices, which are legal but must be disclosed and their objective explained, are said to emit higher levels of nitrogen oxides during real-world driving conditions than during USA emission tests.

"FCA US is now reviewing the complaint, but is disappointed that the DOJ-ENRD has chosen to file this lawsuit", the automaker said in statement.

Less than a week ago, The News Wheel staff reported that the U.S. Justice Department was preparing a lawsuit to file against Fiat Chrysler Automobiles over accusations that the automaker cheated emissions testing for its diesel vehicles.

The software enabled the vehicles to produce lower emissions during roadworthiness tests than they did when used under normal driving conditions. Fiat Chrysler Automobiles also knew as FCA, currently, world's seventh-largest Italian multinational automaker.

Meanwhile, Fiat Chrysler has filed a new application seeking diesel-vehicle emissions certification with the EPA and the powerful California Air Resources Board for its 2017 Jeep Grand Cherokee and Ram EcoDiesel models.

"They can argue all they want the fact that the FCA went after them and Department of Justice (DOJ) is going after them does not look good".

Fiat Chrysler vehicles were allowed to skip key emissions tests during Italy's probe into emissions-cheating software, according to a report earlier in 2017. At the same time, it's planning a software update that it hopes will address officials' concerns - whether or not there was intentional deception, the company isn't taking any chances.

FCA's shares dropped 16 percent in January when the U.S. Environmental Protection Agency (EPA) first raised the accusations, adding the carmaker could face a maximum fine of about $4.6 billion. The company failed to disclose the software during the process to become certified so the vehicles can be sold, according to the EPA.

FCA, the seventh-largest automaker in the world based on total annual vehicle sales, is an worldwide automotive group. Fiat has denied it deliberately cheated in emissions tests. The company's 50 day moving average is $10.64 and its 200 day moving average is $9.89.
