European Union court rejects refugee quota challenge from Hungary and Slovakia

The EU's top court on Wednesday dismissed a challenge by Slovakia and Hungary over the bloc's mandatory refugee quota program, an issue that has divided eastern European states from other members.

Slovakia expressed disappointment but said it would accept the failure of a case that it brought jointly with Hungary, highlighting its reluctance to join Budapest and Warsaw in outright confrontation with Brussels. "That mechanism actually contributes to enabling Greece and Italy to deal with the impact of the 2015 migration crisis and is proportionate", the judges said in their ruling.

European Union countries agreed in September 2015 to relocate 160,000 refugees in Greece and Italy over two years, but only about 24,000 have been relocated so far.

Since compulsory quotas were introduced in September 2015, Hungary has not accepted a single asylum seeker, while almost 28,000 people have been relocated under the scheme, far below the 160,000 target. Hungary and Poland have refused to take part, while Slovakia has only taken in a small number from Greece. The decision is also likely to be welcomed by other countries such as Greece and Sweden, where the sheer volume of new arrivals threatens to overwhelm the system.

As a result in 2015 EU leaders agreed a plan to relocate asylum seekers to other EU countries to spread the burden - with EU leaders agreeing the policy by majority vote despite opposition from Hungary, Slovakia, the Czech Republic, and Romania.

Besides Hungary's legal arguments against the European Union plan, Prime Minister Viktor Orban's government has also made the case and the issue the focal point of its political activities since early 2015 and ahead of parliamentary elections expected in April 2018.

Under worldwide and European law, countries are required to grant asylum to people fleeing war or persecution but not those classed as economic migrants, the EU designation for most sub-Saharan Africans.
